    Summary of outcome

On 19 November 2016 we received a notification of a significant event that a child who attends the nursery had sustained an injury. The provider also notified the Designated Officer within the Local Authority. The notification means that the provider met their legal responsibility as set out in the early years foundation stage welfare requirements relating to ‘accidents and injury’.

    p.1

    Summary of outcome

On 10 January 2017, we completed an unannounced visit to the premises to check the provider continues to meet the requirements of the early years foundation stage. Although not related to the notification, we found the provider had failed to conduct robust risk assessments. Consequently hazards remain accessible to children. Staff failed to check the premises to ensure it is safe and suitable to use. As a result, a fire exit on the ground floor and one on the first floor were obstructed with toys and equipment. The deployment of staff does not meet the safety and well-being of the children at all times. In addition some staff were unclear of their roles and responsibilities.

    Summary of outcome

Consequently, the provider is in breach of the requirements of the statutory framework for the early years foundation stage, which impacts on the Childcare Register requirements.

    p.1

    Summary of outcome

As a result we asked the provider to: ensure that staff conduct regular risk assessments on all areas of the premises children use and the activities they participate in order to identify potential hazards and minimise risks to children’s safety and well-being

ensure that all staff are clear on their roles and responsibilities, particularly where they are covering for staff breaks or absence in rooms with children and activities they are not familiar with.

    Summary of outcome

It is an offence for a person who, without reasonable excuse, fails to comply with a welfare requirements notice. Failure to comply may result in a prosecution.

    p.2

    Summary of outcome

We also issued a notice to improve that asked the provider to; take all necessary measures to minimise any risks to the health or safety of the children and staff (Both parts of the Childcare Register) ensure that children receiving childcare are kept safe from harm (Both parts of the Childcare Register).

    p.2

    Summary of outcome

On 17 January 2017, we conducted a further unannounced visit. We found the provider had taken sufficient action in order to meet the legal requirements. Risk assessments have been improved and the fire escapes are now kept clear. Notices have been placed on the fire doors to remind staff working in those areas to keep them free from obstruction. Hazards have now been removed from the areas used by the children. This ensures children are kept safe from harm. The wall that separated the sleep room from the play room on the ground floor has been removed. This creates more flexibility on the use of the space with the children. Leaders and managers identified that staff failed to follow procedures that were already in place. As a result leaders and managers followed their disciplinary procedures. They have reminded staff of the importance of keeping children safe through effective deployment. This includes using suitability qualified staff to

supervise sleeping children. Staff have also been reminded of their roles and responsibilities to ensure they fully understand the impact of their decisions on children's safety and well-being.

    Summary of outcome

The provider remains registered with Ofsted.

    Publication of compliance action

We aim to ensure that the welfare of children and young people is protected in the services we regulate. The Childcare Act 2006 and accompanying regulations set out our responsibilities to regulate childminders and childcare providers. This includes the enforcement powers we have in relation to those registered providers who do not comply with the requirements for registration. We publish details of any actions we take, or the childminder or childcare provider takes to bring about compliance with requirements on our website for a period of five years commencing on the date we complete our investigation.
