Inspector Barnaby Dowell
This monitoring visit was required to assess the registered provider’s compliance with a notice restricting accommodation. The visit also reviewed the setting’s compliance with safeguarding procedures: In particular, regulation 20 (restraint and deprivation of liberty) of the Children’s Homes Regulations (England) 2015.
p.2
of the Care Standards Act 2000
The compliance notice was imposed on 5 April 2016. The notice required the registered provider not to accept any new admissions. This visit confirmed that the provider has complied with the notice. There have been no new admissions to the home. The young person placed at the home at the time of the notice issue being served continues to live there. Compliance with the Children’s Homes Regulations (England) 2015 . The restriction of accommodation notice was issued following an alleged incident of inappropriate behaviour management practice used by staff in an incident involving a young person. In essence, poor restraint practice was applied. The members of staff who were involved in the alleged incident remain suspended. None of them has worked in the home since their suspension. The police have concluded their enquiries and will take no further action. This followed an interview with the young person whereupon she indicated a wish to ‘forgive’ those

responsible. She was spoken to during this visit and confirmed this. The home has commissioned an investigation into the restraint practice used. This is due to commence on 24 June 2016. A timescale for conclusion is not known. Staff continue to support the young person. The young person’s engagement in the home is varied and appears determined by her use of cannabis. The interim manager states that the young person is smoking cannabis on an hourly basis. The interim manager reported a recent contact at the home between the young person and her parent. This contact occurred without the knowledge of the local authority or the police. The parent is presently subject to police bail following an alleged assault against their daughter. This contact represents a breaking of these conditions. The local authority had identified an alternative provision. The young person has refused the opportunity to move, stating that she prefers to remain at the home.
p.2
of the Care Standards Act 2000
The interim manager states that the home is actively attempting to support her move from the home. On 23 June, the local authority informed the inspector that, due to the delay in planning the move, the potential new placement is now withdrawn. The home does not have a registered manager. A notice of proposal to refuse the registration of the interim manager was issued on 22 June 2016. In conclusion, there are no new admissions to the home. Thus, the home has complied with the notice to restrict accommodation. There has been no reoccurrence of inappropriate behaviour management practices. However, additional concerns have arisen regarding the ability of the home to safeguard the young person. Particularly in terms of her cannabis use and allowing contact to take place in the home with her parent who is currently under police bail conditions not to have such contact. This is a serious shortfall. Therefore the notice to restrict

accommodation at the home remains in place.
