Inspector Seka Graovac

This monitoring visit was required to monitor the registered provider’s compliance with the notice restricting accommodation and to assess the progress made towards achieving compliance with the relevant regulations.

p.2

Inspector Seka Graovac

The accommodation at this home was restricted under section 22B of the Care Standards Act 2000.

p.2

Inspector Seka Graovac

The compliance notice was imposed on 15 April 2016 to run from 18 April 2016 until 30 May 2016. The notice required the registered provider not to have any new admissions. The registered provider fully complied with the notice. There have been no new admissions to the home. The young person who was placed at the home at the time when the notice was served has continued to live there.

p.2

Failures to comply with the Children’s Homes Regulations (England)

The failures related in particular to Regulation 19 (Behaviour management and discipline) and Regulation 20 (Restraint and deprivation of liberty). The failures related to staff training, staff practice and record keeping. They included a lack of training for staff in behaviour management and in their use of restraint. On one occasion, staff used a restraint which involved inappropriate techniques. The unacceptable and disproportionate behaviour management practice in the home put children and young people at risk of harm. In addition, the manager and staff failed to recognise what constitutes a restraint.

p.2

Failures to comply with the Children’s Homes Regulations (England)

At this monitoring visit, the registered person demonstrated that she has taken appropriate actions. All permanent staff have received training in behaviour management. An external training company with 15 years of experience in the area of challenging behaviour delivered the two days of training. The training covered prevention, protection and restoration. It focused on the prevention of challenging behaviour incidents, but also taught staff about breakaway and physical interventions and how to use these techniques safely and appropriately. Further training is scheduled to include a range of relevant topics including awareness of the deprivation of liberty.

p.2

Failures to comply with the Children’s Homes Regulations (England)

Staff have been effective at helping the young person to engage positively and to manage his behaviours well. This has meant that physical intervention has not been necessary.

p.2

Failures to comply with the Children’s Homes Regulations (England)

The registered provider and the staff demonstrated an acceptable level of understanding of good behaviour management, both in terms of practice and required record keeping. Staff described a range of positive and preventive behaviour control measures that they would use in escalating situations. They were very clear that physical intervention was absolutely the last resort. They knew in which situations, and under which conditions, its use was permissible. These approaches were in keeping with the young person’s behaviour management and care plan.

p.2

Failures to comply with the Children’s Homes Regulations (England)

The registered provider has invested additional resources to strengthen the monitoring of the quality of the service, and, in particular, the behaviour management practice. She has appointed an external consultant to visit the home regularly. This professional’s role is to scrutinise policies, procedures and staff practice alongside acting as an adviser.

p.3

Failures to comply with the Children’s Homes Regulations (England)

In conclusion there has been no reoccurrence of inappropriate restraint. The registered provider has taken decisive actions to address the shortfalls, in particular the training of staff in the appropriate use of physical intervention. Staff display a heightened awareness of appropriate behaviour management procedures. Behaviour management plans match the needs of the young person that staff follow in practice. The young person is engaging with staff and is making progress. Therefore, the notice to restrict accommodation is removed.
