    Summary of complaint

On 15 August 2011, we received a complaint that raised concerns about how the setting respond to children taken ill at the setting, changes to the person who is managing the setting and that a child sustained an accidental injury that may have been preventable. We needed to investigate the concern to see if the setting was meeting the Early Years Foundation Stage Welfare Requirements relating to Safeguarding and promoting children’s welfare, Suitable people, Suitable premises and Organisation. In particular, these include requirements that:

    Summary of complaint

We do not investigate to prove or disprove a complaint but we look into the information we receive to see if the childcare provider is meeting all legal requirements. We carried out an unannounced visit to the premises and found that the setting had followed required procedures in respect of changes to the manager. We also found individual health needs were not met because medical treatment was not sought promptly as required in the settings procedures and a child sustained an accidental injury that may have been prevented if procedures had been followed. Risk assessments, policies and procedures are in place to promote and ensure children's safety and well being. However, staff failed to implement them, demonstrating they are not clear about their role and responsibilities and the importance of adhering to policies and procedures at all times. At the time of the visit the setting had already started to take some action to improve staff understanding of policies
