Summary of complaint
On 14 March 2011, we received a complaint that raised concerns that the nursery does not have sufficiently robust systems in place to assess the suitability of those adults working directly with the children, that unvetted staff have unsupervised contact with the children, that ratios are not being met and that staff are not suitably qualified. In addition, concerns were raised about how the nursery meets the individual needs of the children and issues relating to equality of opportunity. We needed to investigate the concerns to see whether the provider was meeting the Early Years Foundation Stage Welfare Requirements relating to 'Safeguarding and promoting children's welfare'. In particular these include requirements which state that all providers must have and implement an effective policy about ensuring equality of opportunities and for supporting children with learning difficulties and disabilities. We also needed to investigate the concerns to see whether

the provider was meeting the Early Years Foundation Stage Welfare Requirements relating to 'Suitable people'. In particular, these include requirements which state that providers must have effective systems in place to ensure that practitioners and other people aged 16 or over likely to have regular contact with children are suitable to do so; that providers must not allow people whose suitability has not been checked to have unsupervised contact with children; that all supervisors and managers must hold a full and relevant level 3 qualification and half of all other staff must hold a full and relevant level 2 qualification and that providers must meet requirements for adult:child ratios. Finally, we needed to investigate the concerns to see whether the provider was meeting the Early Years Foundation Stage Welfare Requirements relating to 'Organisation'. In particular these include requirements that state that providers must have effective systems to ensure

Summary of complaint
We do not investigate to prove or disprove a complaint but we check the information to see if the childcare provider is meeting all legal requirements. We carried out an unannounced visit to the premises and found that Criminal Record Bureau Disclosures and other suitability checks such as, references, health declarations, qualifications and identity checks are carried out for all staff members. Staff members who do not yet have Criminal Record Bureau Disclosures are not left unsupervised with children. Staff are suitably qualified and experienced, including those staff working as supervisors, and ratios are maintained. We also found that the individual needs of the children were being met in relation to their sleep patterns and that appropriate provision is made for children who wish to relax, play quietly or sleep. The setting also has effective written policies in place relating to equality of opportunities and
