Summary of complaint
On 24 March 2011, we received a complaint that raised concerns about complaints made by parents and carers being handled incorrectly and ineffective risk assessment procedures at the nursery. We needed to investigate these concerns to see whether the setting was meeting the Early Years Foundation Stage welfare requirement relating to ‘safeguarding and promoting children’s welfare’. In particular, these include requirements which state that providers must investigate all written complaints relating to the requirements and notify complainant of the outcome of the investigation writing 28 days of having received the complaint. These also include the requirement that providers must keep a record of accidents and inform parents and carers of any accidents or injuries sustained by the child whilst in the care of the providers. In addition, we needed to investigate wither the setting was meeting the Early Years Foundation Stage welfare requirement

relating to ‘suitable people’. In particular, this includes the requirement which states staffing arrangements must be organised to meeting the needs of the children. In addition, we needed to investigate wither the setting was meeting the Early Years Foundation stage welfare requirement ‘suitable premises’. In particular, this includes the requirement to ensure outdoor and indoor spaces, furniture, equipment and toys are safe and suitable for their purpose.

Summary of complaint
We do not investigate to prove or disprove a complaint but we look into the information we receive to see if the childcare provider is meeting all legal requirements. We carried out an unannounced visit to the premises on 18 May 2011. On the day of the visit we found that children were being properly supervised at a range of appropriate activities and there was no evidence their needs were not being met. Risk assessments were detailed and in line with requirements to ensure premises and equipment were safe for children’s use and there was no evidence of hazards to children at the nursery. We made a second, announced visit to the setting on 9 June 2011 to look at records. At this visit, we found that accident records were robust and in line with requirements. However, we found that a written complaint had not been responded to within 28 days of the complaint being made. The provider has already taken effective action to meet requirements through:
