Summary of complaint
On 7th March 2011, we received a complaint that raised concerns about the suitability of people coming into contact with children. We needed to investigate the concerns to see whether the provider was meeting the Early Years Foundation Stage welfare requirements relating to ‘Suitable people’. In particular, these include a requirement which states that 'providers must ensure that adults looking after children, or having unsupervised access to them, are suitable to do so by obtaining an enhanced Criminal Records Bureau (CRB) disclosure in respect of every person aged 16 or over, who works directly with children, who lives on the premises on which the childcare is provided, who works on the premises on which the childcare is provided.'
p.1
Summary of complaint
We do not investigate to prove or disprove a complaint but we look into the information we receive to see if the childcare provider is meeting all legal requirements.
p.1
Summary of complaint
We carried out an unannounced visit to the setting and found the provider had failed to obtain an enhanced Criminal Records Bureau (CRB) disclosure in respect of a member of staff who had worked within the out of school club.
p.1
Summary of complaint
Although it was not part of the original complaint received we found that the provider was not meeting the Early Years Foundation Stage welfare requirement relating to ‘Suitable people’. In particular, these include a requirement which states that 'providers must ensure that adults looking after children have appropriate qualifications, training, skills and knowledge and have a clear understanding of their roles and responsibilities. During the visit it was found that the manager did not have a clear understanding of their roles and responsibilities, especially in relation to keeping children safe from adults working at the setting in the out of school club who had not had an enhanced Criminal Records Bureau (CRB) disclosure obtained.
